Building upon the City’s philosophy of community oriented code enforcement, the division has refocused its energy towards neighborhood preservation in partnership with our citizens and businesses by seeking and developing compliance solutions as opposed to relying on enforcement methods. Additionally, Code Compliance staff works with City departments and divisions and other government agencies, as well as neighborhood coalitions and business owners to assist and empower individuals to resolve outstanding code violations and other challenges.

Notification Process

When a code violation is observed by an officer:

  • Step 1– Correction Request –
  • A Correction Request is a written warning to inform the property owner that a violation of the City code has been found and allow the owner time to correct the violation. When a property owner receives the correction request he/she is encourage to contact the Code Officer and provide information as to what actions will be taken in order to correct the violation. At the end of the time specified in the correction request an inspection of the property will be made by the officer to ensure that the violation has been corrected.

  • Step 2 – Notice of Violation (NOV) –
  • If the property owner fails to correct the violation during the time given in the correction request the officer will then issue an NOV. The NOV will be written and mailed to the property owner listed in the County Tax Collectors data base Certified Mail Return Receipt and /or by posting the NOV at the property. The NOV will indicate a specific number of days in which the violation must be corrected. At the end of the time specified in the NOV a re-inspection of the property will be made by the officer to ensure that the violation has been corrected.

  • Step 3 – Notice of Hearing (NOH) –
  • If at the time of the re-inspection the property still found in violation, an NOH will be given to the owner to appear before the Special Magistrate. The Case is then heard by the Special Magistrate at a violation hearing to determine if a violation did/or does exist.

  • Notice of Repeat Violation/Notice of Hearing (NORV/NOH) -
  • If a repeat violation is found, an NORV/NOH will be given to the owner to appear before the Special Magistrate. The Case is then heard by the Special Magistrate at a violation hearing to determine if a violation did/or does exist.

  • Add – Notice of Violation and Notice of Hearing – (Safety Related or Irreversible Violations) –
  • If the Officer has reason to believe a violation or the condition causing the violation presents a serious threat to the public health, safety and welfare, or if the violation is irreparable or irreversible in nature, an NOV/NOH will be given to the owner to appear before the Special Magistrate. The Case is then heard by the Special Magistrate at a violation hearing to determine if a violation did/or does exist.

  • Special Master Hearing Process
  • Special Master Hearings are typically held on the first Monday and first Thursday of each month at the City of Palm Beach Gardens City Hall on front of the Special Master, who sits as a judge to rule on code violations cases. Functions of the Special Master include making findings of fact and conclusions of law as are necessary to enforce the City’s code of ordinances, and building and zoning codes. The Special Master may issue orders having the force of law commanding whatever steps are necessary to achieve compliance of the violation of the City codes. The violations may include fines not to exceed $250.00 for a first violation, or $500.00 for a repeat violation for each day a violation continues past the day specified by the order; and to lien property where the violation is not corrected within the timeframe specified in the Special Master’s Order.

    Code Compliance News
    Mandatory Water Restrictions – Effective March 22, 2007.
    The South Florida Water Management District (SFWMD) Governing Board has issued a water shortage order (Sec. 373.246, Florida Statutes; Ch. 40E-21, Florida Administrative Code ) imposing mandatory water restriction for South Florida. The mandatory restrictions will be in effect on March 22, 2007. The city of Palm Beach Gardens fall within the area covered by the Lower East Coast which has been classified as Phase I.

    Sign Code Ordinance
    The City of Palm Beach Gardens staff strives to enhance and protect the physical appearance of the City as well as preserve the scenic and natural qualities of all areas in Palm Beach Gardens. The purpose of local sign regulations is to promote the City’s aesthetic appearance. Whether in a residential or commercial neighborhood, all construction, temporary signage, and ‘for sale’ signs require proper permitting. It is illegal to place signs in right-of-ways, including medians. These signs cause deterioration of the community’s appearance and attractiveness. In addition to aesthetic factors, improperly installed signs can block sight lines, provide trip hazards and become projectiles in high winds.

    The City of Palm Beach Gardens staff will be increasing the enforcement of all illegal signs throughout the City. Any sign placed on any right-of-way within City limits will be removed and discarded at the owner’s expense. Please call the Code Compliance Division at 799-4245 to request a copy of the City’s sign code prior to the installation of any sign.
