Impact/Mobility Fees 

LEGAL UPDATE: PB County Road Impact Fees and PB Gardens Mobility Fees

In August 2019, the City of Palm Beach Gardens ("City") abandoned traffic concurrency and road impact fees, electing to adopt a Mobility Plan and Fee in order to mitigate transportation impacts. As of January 1, 2020, the effective date of the Mobility Plan and Fee implementation, the City stopped enforcing Palm Beach County's ("County") traffic concurrency system within the City and discontinued enforcing the County's impact fee ordinance and collecting the fees pursuant thereto. This precipitated litigation between the County and the City in a dispute related to the imposition, collection, and expenditure of County Road Impact Fees versus the City's Mobility Plan and Fees.

The County filed a Motion seeking Temporary Injunctive Relief. A hearing was held on the subject motion, and the Court has ordered the City to begin processing development orders and building permit applications through the County's traffic concurrency program, collecting county road impact fees, and remitting them to the County. However, the Court did not overturn the City's Mobility Plan and Fee. Therefore, commencing July 1, 2023, all applications for all development orders (including building permits) will be processed through the County traffic concurrency program and the City's Mobility Plan and Fee system. This may subject some developers and/or building permittees to paying both fees. The City appreciates the challenge this turn of events may pose.

Letter to all prospective Developers, Contractors, and/or Impact Fee Payer

Overview

The purpose of impact fees is to ensure that new development bears a proportionate share of the cost of capital expenditures necessary to provide fire rescue, police, parks and recreation, roadway and mobility services, and public facilities in the City of Palm Beach Gardens.

On September 19, 2019, the City Council approved Ordinance 19, 2019 which revised the city's impact fees to include a new fee for mobility to replace road impact fees for certain lands in the City. Please click here for more information on the mobility study.

Section 78-95 of the City's Land Development Regulations requires a periodic review of the schedule of impact fees to update costs, credits, and generation rates. Per Section 163.31801, Florida Statutes, the calculations used for the 2017 update were the most recent data localized to Palm Beach Gardens.
