Only sparklers are allowed to be used by consumers. A quick way to remember what is NOT considered a sparkler by the Florida State Fire Marshal’s Office is if it lifts off the ground, explodes, or launches then emits a spark or explodes, it is illegal to use.

Sparklers, by definition, stay on the ground or are held in a person’s hand and emit showers of sparks or smoke. They DO NOT go in the air or explode.

Retail fireworks stores sell fireworks and sparklers to any legal consumer. The buyer signs an affidavit stating they will use the fireworks for agricultural purposes. Unless you own a farm or fish hatchery and are zoned as an agricultural property, possession and use of fireworks is illegal.
